The development came to light when the matter appeared in court earlier today. According to the prosecution team, they received a letter requesting the withdrawal of the case addressed to the Gilbert Phiri, the Director of Public Prosecutions (DPP).
During the proceedings, the prosecution asked the court to adjourn the matter to next month while awaiting instructions from the DPP regarding whether the request to withdraw the case will be approved.
If the DPP agrees to the withdrawal, Mutale Mwanza could be set free, although the court may attach certain conditions to the outcome. However, if the request is rejected, the case will continue to trial, and the State is expected to present more witnesses to testify against the accused.
Background of the Case
The case stems from allegations that on November 7, 2024, Mutale Mwanza used her Facebook page “M-Nation” with the intention to intimidate, harass, or cause emotional distress to Daisy Lusumpa.
Prosecutors allege that several statements made online during the incident were highly offensive, with many of the alleged utterances considered unprintable.
During today’s court appearance, Mutale Mwanza reportedly appeared sombre, dressed in a long red floral outfit as the legal proceedings unfolded.
What Happens Next
The future of the case now rests with the DPP’s decision. If the request to withdraw is approved, the matter may be closed without further trial. But if the DPP refuses, the court will proceed with the case and hear more evidence from the State.
